This is gonna be a long post because to the best of my knowledge, emi has not fully answered the question in the past.
According to a post by emi:
It is strongly recommended the max commanders do not engage in any PvP after max, and wait for the new round. If there is any involvement in the war for the other Top positions by the already maxed commanders, the involved parties may be disqualified from the round.
I wrote him an email sometime ago asking whether max players can attack people's station and planets...this is his reply:

It seems the maxed players can still attack stations / planets in the Galaxy but you should leave the other players to try an max on their own.
I'll see if I can update it so you can not attack planets / galaxy structures.

Rules to max out:
- Have a total of 9.223.372.036.853.190.000 credits or more in Mothership + Secret Base
- Reach and maintain total power of 9.223.372.036.853.190.000 or more in the rankings until the end of DDAY
- Those that max out will have a permanent protection and can not attack or be attacked
Now for a slight history lesson. The whole reason for max players not attacking is to prevent them from influencing players from maxing. In his email to me, he states that even though max players can attack structures, we should leave players to max on their own. So what does this mean? I would assume from emi's post that if say Cammy attacked mj's station (while mj was trying to max and while cammy was already maxed), this would be a definitive breach of the rules. However, amilaender can not max this round. Stations can easily be destroyed even without max ships. Killing stations require the right scanner tech as well...and that require turns to research..and turns is not something max players can just produce. So maybe he hasn't breached any rules? He isn't preventing someone from maxing.
So in summary:
- Emi really needs to details what can or can not be attacked. If it is all attack. Then he needs to say it directly ie. No attack on any player at any time in any way would be very clear.
- Cammy hasn't broken any rules...but the rules for the new round should be confirm by emi.
