Let's suppose some commander is boarding a stronger fleet, with more marines. The boarding is a failure... then the attacked fleet should be able to capture the attacker fleet. I bet most players will be amused to find a report like this: "commander #999999 Fictive Player has boarded your fleet. Your crew fought like lions and captured 999 enemy ships." [/i]

I think marines board other ships in Assault Boats so it would be hard for the Opponents Ship to send back marines before your ships run away. Also it would be quite chaotic after a boarding a party hit your ship. So it does not make that much sense but if the feature is good I don't care if its logical.

In the beginning days of SO it worked like that, but it wasn't a good idea, people complained that they lost too many ships... one of the few things I had to scrap...

maybe make it a tech? something like anti personnel lasers to prevent marines from boarding the attacker and quick response pods to let the defender board. in the case of super ships, it would be almost impossible to have one taken while attacking but if u use swarmers... its not entirely unrealistic that a few commando teams were able to steal a ship or two. ultimatly it wouldn't do much except inflict more marine casualties making it less profitable to board whitch i think in and of itself is a good deterrent/technology to go for.

If you make it like this, just let it only backfire when the attackers ships reach 0 marines in his own attack.

it would be okay as long as the captured ships go into reserve. otherwise u could set somone up for an attack...
for instance, a ship with loads of hp and attack but 1 accuracy. it would survive and be captured. then all the attacker would have to do is attack again and destroy those ships for a successful attack

The capture works only if ships go to 0 marines. And usually nobody would be crazy enough to attack without having at least some superiority, except for scouting purpose. Sir EMI, i thought it could be a good idea. If people would loose to many ships by attacking some other people would loose less ships while defending, so it would be a good balance.

Well on the otherhand we want to make PvP more rewarding, doubt you do that by adding a bigger risk to it.
